Terms of Use

These are the terms for using Tu Palomar, the app and this site. They are written to be understood. If you use the app, you accept them.

1. The account

• You must be at least 13 years old.
• An account belongs to one person. You are responsible for what is done with it and for keeping your password safe.
• Your account details must be true. Do not impersonate anyone.

2. What you can do and what you cannot

Tu Palomar is a place for pigeon flyers to show off, compete and make deals. That comes with one rule of coexistence. It is forbidden to:

• Harass, threaten or insult another flyer, inside or outside messages.
• Post illegal content, or photos of other people without their permission.
• Invent captures, claims or transfers. The system asks the other man to acknowledge a capture precisely so a lie costs nobody anything, but whoever lies for sport loses the account.
• Use the app to locate someone, or to go after their birds outside the sport.
• Sell what is not yours, or what the law does not allow you to sell where you are.
• Extract data from the app automatically, attack it, or try to get around its limits.

If you break this I may suspend or close your account, with notice when possible.

3. Your content

What you upload is yours: photos, videos, names, notes. By uploading it you give me permission to store it, show it inside the app to whoever the privacy policy says, and compose it into the cards you yourself decide to share. That permission ends when you delete it, except for what already left by your own hand: a card you shared on WhatsApp is your file, not the app's.

You are responsible for having the right to upload what you upload.

4. The marketplace and transfers

• Tu Palomar is a notice board between pigeon flyers. I am not a party to any sale: I take no commission, hold no money, and guarantee neither the seller, the buyer nor the bird. The deal, the payment and the handover are between you.
• Follow your local laws on buying, selling and transporting animals.
• A transfer in the app is a record that a pigeon changed lofts, accepted by both sides. It is not a legal title and does not replace any document your federation or your country requires.

5. Captures and rivalries

Captures, claims, wins and losses are sporting records you keep yourselves. A claim counts only once the other man acknowledges it; nobody referees. Tu Palomar does not settle disputes between flyers and is not responsible for what happens in anyone's loft.

6. The Pro subscription

• Price: the one you see in the app and in your country's store. Today, in the United States, $4.99 a month or $39.99 a year.
• Free trial: 14 days, the first time. When the trial ends, the store charges you the plan you chose, unless you cancel at least 24 hours before.
• Automatic renewal: the subscription renews itself at the end of each period, at the same price, until you cancel it.
• Cancelling and refunds: the subscription lives in your App Store or Google Play account, and only there can it be cancelled or refunded (Profile → Manage subscription takes you there). Deleting your account in the app does not cancel the subscription.
• What Pro includes may grow or change. If something you paid for goes away, I will tell you in advance.
• The rest of the app is free, and will stay free.

7. No guarantees, plainly

Tu Palomar is offered as is. I build it with care, but with no promise that it will always be available or free of errors. Keep a copy of what you cannot afford to lose: the app lets you export the pedigree as a PDF and share your cards. To the extent the law allows, my liability for any damage arising from using the app is limited to what you paid for it in the last 12 months.

8. Ending

You can delete your account whenever you want from the app. I can suspend or close it if you break these terms, or if I have to shut down the service, with reasonable notice when possible.

9. The stores

If you installed the app from the App Store, Apple's standard end user license agreement also applies; where the two conflict, Apple's prevails for what concerns Apple. Apple and Google are not responsible for the app or its support: that is on me.

10. Changes and governing law

If these terms change in a way that matters, you will see it here with a new date, and in the app. They are governed by the laws of the State of Florida, United States.
